In case of discrepancies between the French and the English text, the French text shall prevail.
Article 1 - Opposability
The general conditions shall prevail over all other conditions of purchase.
They apply to all sales and are an integral part of the sales contract.
By confirming the order, the buyer acknowledges having read and accepted without reservation. All other documents, such as brochures, catalogs, pictures, sites, issued by the seller are indicative only. No special conditions may, unless formally agreed in writing by the seller, prevail against the general conditions of sale. Anything to the contrary, by the purchaser, will be void against the seller regardless of when it could have been brought to the attention of either party. The fact that the seller does not take advantage of any of these general conditions of sale, one point can not be construed as a waiver to take advantage later of any of these terms.
Article 2 - Changes in general conditions of sale
In case the seller would have to agree, at some point, other purchasers of the conditions (price, payment terms, warranty) that would be more favorable than those provided for in these general conditions of sale for sums, identical quantities and qualities, it would benefit the purchaser from the date of their application to others, except in cases of targeted promotion, ad hoc or limited to the exclusion of the conditions for the test period.
To this end, the seller will send the purchaser, the latter's request, the contents of more favorable conditions that have so incurred.
Article 3 - Order
The order is deemed accepted upon receipt of the order signed by the buyer. The buyer certifies that at the time of his order, he respects the valid order of the Ophthalmologist, or other specialist, and has found no health problems since the prescription. Valique by his order, the buyer expresses sufficiently informed about the products they purchase and that he ultimately waived any further information.
Article 4 - Validation of orders and electronic signature
Any order signed by the Customer, by "clicking" sound is irrevocable. "Clicks" associated with the authentication, non repudiation and integrity protection of messages is an electronic signature. This electronic signature has value, between the parties, a handwritten signature authenticated.
Article 5 - Amendment of Order
Any change or cancel the order requested by the buyer will be considered only if received by the seller in writing.
The seller agrees exceptionally modification of the order if the reason is a prescribing error or reading it. In this case, the buyer will return the seller of the products ordered in error, unopened, that is to say evidence of sanctity intact. To permanently resolve this situation, other products conform to the prescription will be shipped to him.
A copy of the new requirement must be submitted by the customer.
Article 6 - Trial period of 30 days
For his first command of one of our products, the buyer has a trial period of 30 days of receipt of these products to be tested (the date indicated on the delivery by carrier authentic). If at the end of the trial period, and for whatever reason, the buyer wanted to abandon its purchase, it should return to his office, the merchandise in its original packaging, within 8 days after the end of the trial period. Products not necessary for the test will bear evidence of sanctity intact. So the purchase would be repaid within 10 days after receipt by our company, subject to review the package contents and condition of packaging.

NO REFUNDS WILL BE MADE.
Section 7 - Shipping - Transportation
Unless otherwise agreed, delivery is made by delivering the product directly to the purchaser, either by simple notice of availability.
If delivery is delayed for any reason beyond the control of the Seller will be deemed to have occurred on the date agreed. A delay does not entitle the buyer to cancel the sale or reject the goods. It can also not be eligible for withholding, penalties, restitution or compensation.
Goods travel at the risk of the client it belongs to verify the good state at the time of delivery. In any event, no claim will be considered after a period of 8 days of delivery.
If assigned to a carrier, the goods have suffered loss or damage, the customer must be accurate and complete reservations on the transport document, failing which his claim is forfeited, it will repeat its protest grounds in the manner and time under applicable laws in his state.
Transportation costs for the possible return of goods are charged to the Customer; exceptionally they may be borne by the seller if it was a mistake in ordering or delivery.
Without prejudice to be taken vis-à-vis the carrier claims on defects or non-compliance of the product delivered, compared to the ordered product or the packing slip, must be made in writing within 8 days after arrival of goods.
It is the buyer to provide any justification as to the reality of defects or anomalies. It will allow the seller to make it easy for the recognition of these defects and to remedy. He will not intervene himself or let a third party for that purpose.
Article 8 - Retention of title
The seller retains ownership of the goods until payment of the full price of principal and accessory. Failure to pay may result in claims of property. These provisions do not prevent the transfer to the buyer upon delivery, risk of loss and deterioration of goods sold, and the damage they could cause.
Section 9 - Prices - Conditions of Payment - Penalties
The prices are specified, unless otherwise stated in € (EUR) and include VAT, when applicable, at the rate prevailing at the date of invoice. They do not include shipping and delivery charges charged extra as indicated before the final confirmation of the order. The seller reserves the right to change prices at any time until the acceptance of the order, they are deemed contractually accepted. Goods and services are payable to the order prior to shipment of goods by any means valid bank with a major bank such as bank transfers, credit cards (VISA, EUROCARD, MASTERCARD). Upon payment, the order will be shipped within 48 hours on weekdays. If a previous order, the purchaser has evaded its obligations (default, breach of warranty or test), a refusal to deal may be opposed. No rebate or discount for cash payment or advance is granted.
Article 10 - Product Warranty and "money back guarantee"
The seller guarantees the quality of its products. If the buyer is not satisfied, the seller reimburses the buyer within 15 days of purchasing the goods. The buyer will simply return the unopened and not damaged at his expense by parcel post to PO Box indicated on the invoice.
Article 12 - Settlement of disputes
For the interpretation hereof, the Parties agree to apply the Laws of the State of Luxembourg, even if the warranty claim or multiple defendants.
Any disputes will be subject to arbitration prior amicable to be admissible. The mere reimbursement of goods, the customer, or the loss by the seller of the goods delivered are accepted, a priori, as a rule of compensation between parties and permanent abandonment of any appeal.
Failing agreement, the parties agree to the exclusive jurisdiction of the courts of Luxembourg and, ultimately, to the competent European Courts.
